Agreeing to these terms

These Terms of Service ("Terms") govern your access to and use of Freedom Wallet, a self-custodial cryptocurrency wallet for Zano, Monero, and fUSD that lets you store, send, receive, and swap supported assets, as provided by Freedom Wallet Ltd, a company registered at Building #1, Nelson Spring Business Complex, Nelson Spring, Nevis ("Freedom Wallet", "we", "us", or "our"). They cover the Freedom Wallet app and this website. By downloading, accessing, or using either, you agree to these Terms and to our privacy policy. If you do not agree, do not use them.

Self-custodial nature of the service

Freedom Wallet is a self-custodial tool. We do not hold, access, store, or control your funds, private keys, or seed phrase at any time. Your keys and funds reside only on your device and are managed exclusively by you. All transactions are broadcast directly to the underlying blockchain networks, such as Zano and Monero, and are executed peer-to-peer. We are not a bank, money services business, custodian, exchange, or financial institution, and we do not act as an intermediary to your transactions.

Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and legally capable of entering into a binding contract to use the app. By using the app, you represent and warrant that you meet these requirements and that your use complies with all laws applicable to you.

Your wallet and security responsibilities

  • Seed phrase. When you create a wallet, the app generates a seed phrase that is the sole means of recovering your wallet. You are solely responsible for recording and securely storing it offline.
  • No recovery. We cannot access, reset, or recover your seed phrase, password, or funds. If you lose your seed phrase, your funds are permanently and irreversibly lost.
  • Device security. You are responsible for maintaining the security of your device, operating system, and any biometric or PIN protection used to access the app.
  • Transaction accuracy. Blockchain transactions are irreversible. You are responsible for verifying recipient addresses, amounts, aliases, and network fees before confirming any transaction.

Fees

The app is free to download and use. You do not pay us to store, send, or receive supported assets. Transactions on the underlying networks require network (miner) fees paid to the network, not to us. These fees are set by the network and are outside our control.

Network access and third-party services

The app requires internet access to function and relies on public and third-party services to fetch exchange rates, blockchain data, network status, and other information. These may include, without limitation, network nodes and block explorers, price data providers, and infrastructure services. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, downtime, rate limits, or errors of any third-party service, nor for any resulting loss.

Swaps and third-party exchange providers

Swaps, on-ramps, and the auto-convert into fUSD are provided by independent, self-custodial third parties. Their own terms apply when you use them, and we don't control their rates, availability, or outcomes.

fUSD and stablecoin risk

fUSD is a stablecoin on the Zano network. It is not issued, controlled, or guaranteed by Freedom Wallet. Like any stablecoin, it can lose its peg or its value, and we make no promise about its price or redeemability. Hold and use it at your own risk.

Payroll and business use

If you use Freedom Wallet to pay a team, contractors, or contributors, you are responsible for your own compliance with employment, tax, and anti-money-laundering rules, and for the recipients and amounts you pay. We provide the tool, not legal or accounting advice.

Acceptable use

By using Freedom Wallet, you agree not to:

  • Use the app for any unlawful purpose, including money laundering, terrorist financing, fraud, tax evasion, or the financing of sanctioned activities;
  • Use the app to transact with funds derived from, or intended for, illegal activity;
  • Reverse-engineer, tamper with, decompile, or exploit the software or attempt to gain unauthorized access to any system or data;
  • Introduce malware, interfere with the operation of the app, or place an unreasonable load on supporting infrastructure; or
  • Violate any applicable law, regulation, or third-party right.

We reserve the right to restrict access to features or take other appropriate action in response to a suspected breach, to the extent technically possible given the self-custodial nature of the app.

No financial, investment, or legal advice

Freedom Wallet provides technical tools only. Nothing in the app or these Terms constitutes financial, investment, tax, accounting, or legal advice, or a recommendation to buy, sell, or hold any cryptocurrency. Cryptocurrency values are volatile and you may lose the entire value of your holdings. You are solely responsible for your own decisions, for evaluating the risks, and for complying with all tax and reporting obligations applicable to you. You use the app at your own risk.

Intellectual property

All intellectual property rights in and to the app — including its code, user interface, brand, name, logos, and content — are owned by Freedom Wallet Ltd or our licensors. You acquire no ownership rights; we grant you only a limited, non-exclusive, non-transferable license to use the app for your personal and business use. You may not copy, modify, redistribute, or claim ownership of it, and the Freedom Wallet name and logo may not be used without permission. Open-source components remain governed by their respective licenses.

Limitation of liability

To the maximum extent permitted by law, we are not liable for:

  • Lost, stolen, or inaccessible funds, private keys, or seed phrases;
  • Failed, delayed, duplicated, or incorrectly addressed transactions;
  • Losses arising from third-party API, node, network, or infrastructure failures;
  • User errors, device compromise, malware, or device-level misconfiguration; or
  • Fluctuations in the market value of any cryptocurrency.

You are solely responsible for securing your own wallets, seed phrases, and backups. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence or for fraud.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Freedom Wallet Ltd and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the app, your violation of these Terms, or your violation of any law or third-party right.

Updates and changes to the terms

We may update these Terms or the app's features at any time. Where changes are material, we will take reasonable steps to notify you, such as through the app or our website. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

Suspension and termination

You may stop using the app at any time. We may suspend, restrict, or discontinue the app or any feature, in whole or in part, at any time. Because the app is self-custodial, discontinuation of the app does not affect your ownership of your funds, which remain recoverable using your seed phrase in any compatible wallet.

Governing law and dispute resolution

These Terms are governed by the laws of Nevis. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Nevis, except where mandatory law grants you the right to bring proceedings in your country of residence.
